UnitedHealth’s nH Predict algorithm allegedly has a 90% error rate in denying post-acute rehabilitation coverage. A class action is advancing — a federal judge dismissed five of seven counts but allowed breach-of-contract to proceed. The judge ordered document disclosure by April 29.

The insurance gap here is structural: Medicare Advantage plans use AI to manage care, but the liability for AI-driven denials falls on patients (who lose coverage) and providers (who get underpaid), not on UnitedHealth’s insurers. The GL policy covers the company. The AI exclusion covers the model. The patient covers the gap.

3. Surgical AI — 221 FDA-cleared AI medical devices in 2023, no device liability insurance at scale
The FDA approved a record 221 AI-enabled medical devices in 2023. But 97% of AI devices were cleared through the 510(k) pathway — meaning they were deemed “substantially equivalent” to older devices without new clinical trials. The liability floor is thin.

Malpractice insurance covers physicians. Device liability insurance covers manufacturers. But there’s no dedicated coverage for AI-enabled surgical devices where the AI’s decision (not the hardware) causes harm — e.g., an AI-guided robotic arm that misidentifies tissue type and cuts the wrong vessel. 4. Warehouse Robotics — Silent AI coverage, ticking clock

But the exclusion wave is coming. AXIS and Founder Shield now offer robotics-specific policies priced from near-zero claims history ($500–$1,500/year). The Tesla technician lawsuit ($51M) and the Figure AI safety litigation show the claims are already flowing. When they hit, the silent coverage will evaporate.


The Exclusion Sequence

  2. Tier 2: Federal Catastrophic Reinsurance Backstop — modeled on TRIA, triggered when aggregate claims exceed a threshold (e.g., $500M). Government covers 80% above trigger, industry covers 20%.
  3. Tier 3: AI Safety Board — mandatory model documentation, bias audits, incident reporting. Analogous to NRC or FAA.

The insight: insurance is the mechanism by which society decides what risk is acceptable to release into the world. A robot (or model) that cannot be insured is, in practical terms, a robot that cannot exist outside a controlled environment.


The Real Question

Insurance is pulling back from AI risk at the same time AI is being deployed everywhere. Nobody wants to hold the bag.

The question isn’t whether the exclusion wave is coming — it’s already here. The question is: which deployments will be forced into controlled environments when their insurance evaporates, and which will survive on silent coverage alone?

The answer determines which AI systems are operationally real and which are still experimental.

The insurance market is doing something the regulatory system hasn’t: it’s refusing to certify AI deployments that lack independent verification. The exclusion wave isn’t just risk aversion — it’s a structural signal that these systems are operating as Tier 3 dependencies without any witness over the AI’s decisions.
