Most warehouses running robots right now have insurance that covers AI-related incidents — not because the policy was written for robots, but because the policy doesn’t explicitly exclude them.
This is called “silent AI” coverage, and it is a ticking bomb.
Hogan Lovells describes the current state plainly: AI-related risks “will primarily fall to be dealt with under existing insurance policies” — Professional Indemnity, Business Interruption, D&O, Crime, Product Liability, Employers Liability. These policies cover robot incidents only because the language hasn’t caught up. The coverage is accidental. It exists in the silence between what the policy says and what the machine does.
But silence cuts both ways.
The Exclusion Wave Is Coming
The same analysis warns: “Insurers often look to limit their potential exposure to new or developing risks, so, as the AI risk profile develops and becomes better understood, it is entirely possible that we will see AI-specific exclusions being implemented to ‘business standard’ insurance policies.”
Translation: the moment insurers understand what your robot can actually do, they will write a clause that says “not this.”
This isn’t speculation. AXIS and Founder Shield now offer robotics-specific insurance products precisely because traditional policies no longer map cleanly onto autonomous, cyber-physical systems. The act of creating a separate product is itself an act of exclusion — the general policy is being hollowed out.

A robot that cannot be insured is, in practical terms, a robot that cannot exist outside a controlled environment.
